The Albanese government is considering a crackdown on non-compete clauses after a study revealed their widespread use across Australia. However, employment law expects have warned that an outright ban would have unintended consequences for Australian businesses.

The Australian Bureau of Standards (ABS) poll found that more than one-in-five (21%) businesses used non-competes to limit staff moving to competitors in 2023.
