Unison to appeal decision allowing workers to be disciplined for striking

A recent Court of Appeal judgment gives employers the green light to discipline staff who engage in union-organised disputes, public sector union Unison has warned as it announces plans to overturn the decision before the UK Supreme Court.

The long-running case began in 2019 and was brought by care worker Fiona Mercer against her employer, the Alternative Futures Group (AFG). Mercer had been involved in union organising, and subsequently took part in, a long-running dispute over AFG’s plans to cut payment for sleep-in shifts undertaken by its care staff.
