NLRB expands joint-employer standard to indirect control

In a decision with far-reaching implications for US businesses, the National Labor Relations Board (NLRB) released a new rule on Thursday that controversially broadens the joint-employer standard under the National Labor Relations Act.

The new standard adds new risks and liabilities to franchise relationships, as well as companies that use vendors, temporary labour, gig workers, or other contractors. The rule is expected to impact large companies, such as McDonald’s, that are not typically involved in franchisees’ day-to-day workplace issues.
