An important new decision from France’s Conseil d’état (Council of State), the Supreme Court for administrative justice, on 15 November could lead to a refusal of the labour administration to authorise the dismissals of ten or more employees from a business for economic reasons.

In France, when considering dismissing at least ten employees for economic reasons, the employer must put in place a procedure for safeguarding employment. This procedure must include:
