Australia’s Law Council warns costs reforms could overwhelm courts

The Law Council of Australia (LCA) has expressed concerns over plans to remove cost barriers for applicants in sexual harassment and discrimination cases, warning that reform could lead an influx  “unmeritorious and protracted” claims.

Introduced in November, an “equal access” model to the Australian Human Rights Commission Amendment (Costs Protection) Bill 2023 could see unsuccessful applicants in employment proceedings protected from adverse costs orders.
