US employers can expect an explosion of wage and hour litigation in 2022, thanks to the continued migration of plaintiffs’ class action lawyers into the space and a more worker-friendly Department of Labor making wage theft an enforcement priority.
Seyfarth Shaw’s latest workplace class action report shows that plaintiffs converted 226 of 279 wage and hour filings into class actions in 2021, a success rate of 81% and the second-highest certification rate in over two decades.
