FWC: Lack of written contract does not determine employment

Australia’s Fair Work Commission has found that a contract worker is an employee despite her providing the company with invoices and the lack of a written contract.

Eunjin Lee started working as a tiler and grouter for P&K Total Services on 22 May 2022 without a written employment contract. On 11 July 2023, Lee claimed to have been dismissed. The company insisted Lee was an independent contractor.
