Federal Labour Court ruling an equal pay warning to German employers

Employers in Germany are anxiously awaiting the release of a full Federal Labour Court decision that found negotiating skills are no justification for unequal pay.

Although German labour law prohibits discrimination based on gender, some employers have historically been able to argue that differences in pay between male and female staff was a result of male employees being better negotiators.

Lower labour courts have typically approved this view, finding that employee recruitment was an objective reason for variances in pay. But that is all about to change.
