Kromann Reumert’s full-service offering boasts a reputed employment and labour department that is able to deftly handle major domestic and cross-border employment issues, and regularly works alongside market-leading magic circle teams on international projects.

Marianne Granhøj in Copenhagen leads the team, within which Jens Lund Mosbek is another key name.

Specialisms

The team is well-versed in the gamut of HR issues impacting personnel management, as well as more strategic one-off issues and investigations.

M&A and restructuring are also areas of activity for the group, which is able to work alongside experts in other practice areas of the firm to support with the employment aspects of corporate operations, including complex cross-border mandates.

This was demonstrated in support to FLSmidth in its purchase of Thyssenkrupp’s mining business for €325m, which impacted operations in 24 jurisdictions and almost 3,500 employees. The team co-ordinated the employment law side from Copenhagen, which involved a country-by-country carve-out from the seller’s other operations.

Policy development is a further area of practice. Granhøj acted for the Confederation of Trade Unions in Denmark in its capacity as employer on establishing a consolidated policy against sexual harassment and bullying for its employees. The firm also handles the confederation’s related whistleblower scheme.

In addition, the firm is well placed to represent employers in contentious matters. For example, Mosbek acted for Swedish oil and bitumen products manufacturer Nynas on an investigation into irregularities by a Danish employee, leading to the worker’s dismissal. Mosbek subsequently successfully defended the manufacturer in an unfair dismissal claim, and the court ruled that the claimant was liable for certain costs incurred.

Members of the department also regularly represent clients subject to discrimination claims, including before the Danish Board of Equal Treatment. Mosbek was also successful in his representation of the municipality of Horsens before the Supreme Court in a discrimination case regarding pensions contributions by former civil servant employees.

As part of its expertise, the department is able to advise beyond traditional employer-employee relationships, including those relating to subcontracting. A key client in this space is food delivery provider Gorillas, which the group provides ongoing advice to regarding platform work, contracts, and collective labour law and collective bargaining with unions.
