Overview
Kochhar & Co’s employment team is led by the “incredibly good” Suhas Srinivasiah in Bangalore, alongside co-head Debjani Aich. Team members are also based in Mumbai, New Delhi, Chandigarh, Chennai, Gurgaon, and Hyderabad.
Aside from its extensive footprint in India, the team offers a global reach through its membership of the Ius Laboris network.
Specialisms
The team boasts a wide breadth of know-how in employment and labour law matters, from remote working arrangements through to terminations, and is adept at helping companies navigate Indian legislation and mitigating risk.
Notably, the team is instructed by a number of major clients from the TMT sectors. For example, firm chair Rohit Kochhar acted for entertainment giant Fox on all employment issues related to its establishment of a subsidiary in India in 2021. Assistance included drafting employment agreements for permanent and fixed-term staff, and advice on tax efficient salary structuring.
The team also acts for the London office of Warner Media. As part of its myriad advice, the group in the past year has assisted with statutory employee benefits, including those under the Payment of Gratuity Act.
In addition, the team has been particularly active of late advising clients on changes to the labour code. For example, Savitha Jagadeesan in Chennai advised Thryve Digital Health on updating its leave policy in light of the new legislation.
A further notable area of activity is in the employment aspects of varied corporate matters, including the Indian leg of cross-border M&A or acquihires, as well as operational shut downs. The firm’s skillset in this area includes employment due diligence, and employee transfer and integration.
The group also offers particular expertise in the Prevention of Sexual Harassment in the Workplace (POSH) Act. In addition, the team can draw on the expertise of white collar crime and intellectual property specialists at the firm to advise on trade secrets issues, and can support in contentious matters.
