Overview

Cliffe Dekker Hoffmeyr’s employment practice is led by Aadil Patel in Johannesburg. Team members are also based in Cape Town and Nairobi.

The team services a wide array of local and international clients, including those in the aviation, financial services, natural resources, and TMT sectors. As well as private companies, the group also acts for government departments and state-owned enterprises.

Specialisms

The team provides comprehensive support across all labour and employment law issues, from drafting employment contracts and restraint of trade agreements through to health and safety.

The department represents clients in litigation and alternative dispute resolution proceedings before a variety of forums, including employment tribunals, appeal courts, and the Commission for Conciliation, Mediation and Arbitration (CCMA). Experience spans unfair dismissals, collective agreements, strikes, and discrimination.

Compliance audits are another area of expertise, within which team members advise on compliance with legislation, collective agreements, or arbitral awards or court rulings. Expertise in this space extends to health and safety compliance.

The team regularly supports in corporate transactions, including advising on the employment due diligence of business transfers or transfers of undertaking.

The department is also well placed to act on immigration, benefits, and pensions.

In addition, team experts support clients with seminars, training sessions, and workshops on key issues, such as how to carry out disciplinary hearings.
