Basham, Ringe y Correas labour, social security, and immigration practice group is a go-to team for leading international firms that require assistance with complex employment or labour matters in Mexico.

Clients frequently instruct the team on strategic issues, including staff restructurings and expansion projects, as well as support with novel issues impacting workforces – such as remote working arrangements.

The departments status as a go-to for international firms requiring assistance on sophisticated matters was demonstrated in partner Álvaro Gonzálezs advice to Yazaki on the restructuring of its operations in Mexico. The restructuring will impact 52 manufacturing plants and involve collective negotiations with 60,000 employees.

The department has a strong track record of negotiating with Mexicos unions, helping its clients avoid work stoppages through industrial action. For example, Monterrey-based partner David Puente, alongside de Presno, successfully advised the owners of the Consorcio Minero Benito Juarez Peña Colorada on avoiding a strike in May 2022. The mine is the country’s third largest by number of employees. 

Another standout mandate for the team was its advice to oil and gas giant BP on its expansion into Mexico. This included the negotiation, execution, and termination of hundreds of collective bargaining agreements with unions representing the sellers staff as well as the clients, subcontracting schemes, and due diligence.

The group also boasts a solid litigation practice and, in particular, is well-versed in representing companies in discrimination and employment status claims. For example, de Presno is leading a team advising Barclays Bank on a long-running dispute with ex-employees of Lehman Brothers. The case stems from Barclays’ purchase of substantial Lehman Brothers’ global assets. The claimants argue that Barclays is a surrogate employer even though it did not buy Lehman’s Mexico holdings.
